Overview

North West Leicestershire District Council is proposing to introduce a Public Space Protection Order (PSPO) under Section 59 of the Anti-social Behaviour, Crime and Policing Act 2014. The restricted area within the Order will cover the town centre of Ashby including Bath Grounds and Hood Park.

The proposed terms would be to prohibit:

1) The use or possession of alcohol in a public area (licensed premises would be exempt)

2) The use or possession of psychoactive substances along with any associated paraphernalia – this would include Nitrous Oxide/Laughing Gas (capsules and balloons), Khat, Spice and Mephedrone.

These prohibitions will only apply where an authorised officer believes that this is the cause, or is likely to be a cause, of anti-social behaviour.

Why your views matter

Ashby is a safe place to live, work and visit. It is also a vibrant town with a great selection of pubs, cafes and restaurants. Like any town of a similar size, there are isolated incidents of anti-social behaviour that are caused by alcohol and/or the use of psychoactive substances (in particular, nitrous oxide – you may see evidence of this with the small metal canisters littering the grounds up and down the country) in public areas. The PSPO will enable the police to request that items are confiscated from a person who is in breach of the Order otherwise they may be liable for a fine.

If approved, the Order will not impact upon the majority who use the town responsibly. It will be in place to make Ashby even safer and provide a tool to tackle the cause of anti-social behaviour involving alcohol and/or psychoactive substances in public areas quickly and effectively.

The order will not apply to licenced premises and it will not make it an offence to carry or consume alcohol in public. It may become an offence if alcohol (whether in open or sealed containers), psychoactive substances, or any associated paraphernalia is not handed over when requested to do so by an authorised officer.

The PSPO is a proposal at this stage and, we are asking for the views of people who live, work, visit, or have an active interest in the use of Ashby town centre before we progress it.
